Terms of service
1. Who can use the app
You must be at least 13 years old, or older if the law where you live sets a higher minimum age for using a service like this without a parent. If you're under the age of majority where you live, a parent or guardian must agree to these terms for you. If you're using the app on behalf of an organisation, you're confirming you can bind it.
2. Your account
The free plan needs no account. Paid plans do. Keep your sign-in details to yourself and tell us if you think someone else is using them. Your backup is encrypted on your device. If you keep account recovery switched off and lose access to all your devices and your recovery phrase, nobody — including us — can recover the contents. If you switch recovery on, we hold a recovery key and can restore your vault once you've proved it's you; the privacy policy explains what that means.
3. Plans, trials and payment
Free includes unlimited capture, memory and recall, six tracking cards, charts over a trailing 30 days, and full export. Plus is $9.99 a month or $99.99 a year. Family Plus starts at the Plus price for the first member, with each added member 10% cheaper than the one before, up to five. Prices are in US dollars, before any tax, and may differ by country in the app stores.
Free month. Every new download includes one month of Plus at no charge and with no payment method required. When it ends you choose whether to subscribe or continue on Free; we don't start charging you automatically at the end of the free month.
Subscriptions are sold through the Apple App Store or Google Play and are governed by their terms. They renew automatically until you cancel in the store; refunds are handled by the store under its rules. We can't cancel or refund a store purchase ourselves.
If a subscription ends, backup and sync stop. Everything on your device stays, and export keeps working. We keep your encrypted backup for 30 days in case you return.
4. Family Plus
The person who buys Family Plus is the owner and is responsible for payment. Each member has their own vault and their own settings, and decides for themselves what to share. The owner can remove a member from the plan; that stops the member's paid features but does not touch their data. Members must be 13 or older.
5. Sharing and connections
You control what you share, with whom, and when. What you share is for the other person's personal use. Don't share other people's private information without their permission, and don't use the app to monitor someone who hasn't agreed to it. A connection can be ended by either person at any time. What has already been delivered to someone stays with them.
6. Professionals and clients
A professional plan ("Pro") for coaches and similar professionals is in development. When it launches, a professional's clients will never be charged for the connection, a professional will only ever have the read access the client chooses to give, and additional terms for professionals will apply. Additional terms for professionals, including any referral programme, will be published before Pro launches.
7. Your content and your rights to it
Everything you put into the app is yours. We claim no rights over it. Where we need a limited permission to operate the service — for example to store your encrypted backup or relay a request to someone you've connected — you give us that permission, for that purpose only, for as long as you use the feature. You can export all of your content at any time, on any plan, and export never gets worse when a subscription ends. You can delete it all as described in the privacy policy.
The app software, our websites, our name and our designs belong to us or our licensors. We give you a personal, non-transferable licence to use the app on devices you own, subject to these terms and the app store's terms.
8. Not medical advice
My Prime DATA records what you tell it and shows you patterns in what you recorded. It is not a medical device, does not diagnose or treat anything, and does not give medical, psychological or nutritional advice. A pattern the app shows is a description of your logs, not a conclusion about your health. Don't make health decisions on the basis of the app alone; talk to a qualified professional. If you think you are having an emergency, contact emergency services.
The app may misunderstand what you said. Always check what it recorded, especially for medications, and correct it.
9. Acceptable use
Don't use the app or our services to break the law, to harm or harass anyone, to monitor someone without their consent, to interfere with the service or other people's use of it, to reverse-engineer or copy the app beyond what the law allows, or to build a competing product from it. If you connect a third-party model or service, you're responsible for your account with that provider and for complying with its terms.
10. Our rights
We can change, suspend or discontinue features, and we can suspend or close an account that breaks these terms. If we discontinue the service, we'll give you at least 90 days' notice and you'll be able to export everything.
11. Ending things
You can stop using the app at any time and delete your account as described in the privacy policy. These terms end when you do; the sections that by their nature should survive (your content rights, disclaimers, liability, disputes) survive.
12. Disclaimers
The app and services are provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including fitness for a particular purpose and non-infringement. We don't promise the app will be error-free, that it will understand you correctly, or that patterns it shows are meaningful.
13. Limitation of liability
To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost data, profits or goodwill, arising from your use of the app or services. Our total liability for any claim is limited to the greater of the amount you paid us in the twelve months before the claim and US$50. Some places don't allow these limits, in which case they apply to the extent permitted.
14. Disputes and governing law
These terms are governed by the laws of the State of Wyoming, USA, without regard to conflict-of-law rules and to the extent your local consumer law allows.
Talk first. If we have a dispute, either of us emails the other with a short description and what we'd like done, and we both try in good faith to sort it out for 60 days before doing anything else.
Arbitration. If that doesn't work, you and we agree to resolve the dispute by binding individual arbitration run by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court. The arbitrator can award whatever a court could, but only to you individually. Arbitration can be by video or phone, or in the US county where you live. We pay all AAA filing and arbitrator fees for claims under US$10,000 unless the arbitrator finds the claim frivolous. Either of us can still bring an individual claim in small-claims court where it qualifies, and either of us can go to court to stop infringement or misuse of intellectual property.
No class actions. Claims can only be brought individually, not as a plaintiff or member of any class, collective or representative proceeding. If this sentence is found unenforceable for a particular claim, that claim goes to court, and the rest of this section still applies to everything else.
Your right to opt out. You can reject arbitration by emailing support@myprimedata.app with the subject "Arbitration opt-out" within 30 days of first accepting these terms. Say who you are and that you're opting out. Nothing else about the terms changes if you do.
If we end up in court. Anything that isn't arbitrated goes to the state or federal courts in Sheridan County, Wyoming, and you consent to that — unless the consumer law where you live gives you the right to sue at home, in which case it applies.
15. Changes
If we change these terms in a way that matters, we'll tell you in the app at least 30 days before the change takes effect. Continuing to use the app after that means you accept the new terms.
